Advice

 
The starting point regarding the publication of advice of the Social and Economic Council is transparency to promote the public debate on the issue at hand. Article 80 of the Constitution of Sint Maarten dealing with the publication of advice of the Social and Economic Council is based on this principle. Transparency and publication are vital characteristics for good governance.  
 
National Ordinance on open government.pdf article two further emphasizes on transparency. According to article ten of this ordinance the advice of the Social Economic Council is made public by the Minister of General Affairs of Sint Maarten. If an advice concerns a draft national ordinance, the advice shall be made public together with the draft ordinance when submitted to parliament. All other advice on draft law, for example a draft decree, shall be made public together with the decree in the official government publication. All other advice will be made public within six weeks after the advice has been issued.

This advice is a solicited advice at the request of the Parliament of Sint Maarten. The President of Parliament, the honorable Mrs. Sarah Wescot-Williams, sent the advice request of former member of parliament of the National Alliance, Mr. Christophe Emmanuel, to the SER. The SER received the request on the 22nd of January, 2016. Mr. Emmanuel gave an elaboration on the advice request to the Social Economic Council (SER) on February 25th, 2016. Between February and August of 2015 the Social Economic Council (SER) in collaboration with the University of St. Martin (USM) executed a scientific research regarding the decision making process of highly educated Sint Maarteners abroad to return to Sint Maarten. The SER initiated this research because the return of highly educated Sint Maarteners is economically and socially important, but it is unclear which factors determine the decision of Sint Maarteners abroad to return or not.

About Us
The Social Economic Council is an independent advisory organization of the country of Sint Maarten. The board consists of three representatives from employers' organizations, three representatives from employees' organizations, and three independent experts.
